In a decision of the First Civil Chamber dated October 5, 2022, published in the Bulletin, the French Supreme Court (Cour de cassation) provides useful clarifications on the notion of substantial investment, a prerequisite for the protection of the database producer, and enshrines the possibility of autonomous protection of a sub-database, qualified as qualitatively substantial, under the sui generis right.
